Definitions

1.1. The terms used in these Regulations mean:
a) Buyer - a natural person who is over 18 years of age and has full legal capacity or a natural person or organizational unit other than a natural person, which is granted legal capacity by special provisions - who places an Order (including in particular the Consumer);
b) Consumer – a natural person concluding a civil law transaction with an entrepreneur that is not directly related to his or her business or professional activity;
c) Civil Code - Act of April 23, 1964 (Journal of Laws of 1964, No. 16, item 93, as amended);
d) Regulations - these Regulations for services provided by the GoodyWoody online store;
e) Online store (Store) - an online service operating at www.goodywoody.com.pl, through which the user may, in particular, place Orders;
f) Goods – products presented in the online store;
g) Sales Agreement - a contract for the sale of Goods within the meaning of the Civil Code concluded using the website of the online store between the Buyer and Karolina Zielińska running a business under the name "Goody Woody Karolina Zielińska", ul. . Jana Kazimierza no. 9, lok. 29, 01-248 Warszawa NIP: 1132754707, REGON: 142164527, entered into the Central Registration and Information on Economic Activity (CEIDG) kept by the Minister of Economy;
h) Act on Consumer Rights - Act of May 30, 2014 on Consumer Rights (Journal of Laws 2014, item 827);
i) Act on electronic services - Act of 18 July 2002 on services provided electronically (Journal of Laws No. 144, item 1204, as amended);
j) Order - the Buyer's declaration of will, resulting directly in the conclusion of a sales contract, specifying in particular the type and number of Goods.

General provisions

2.1. These Regulations specify the conditions for concluding contracts for the sale of goods and purchases via the Internet, which constitutes the document referred to in Art. 8 section 1 of the Act on the provision of electronic services.
2.2. Online store and website operating at www.goodywoody.com.pl, run by Karolina Zielińska running a business under the name "Goody Woody Karolina Zielińska" (hereinafter: "GoodyWoody") and registered in the Central Registration and Information on Economic Activity (CEIDG). ), run by the Minister of Economy.

2.3. In order to use the online store, the Buyer should, on his own, request access to a computer workstation or device equipped with an Internet connection.
2.4. The Buyer may use the online store provided that its IT system meets at least the following technical requirements:
a) Internet Explorer 9.0 or a newer version with JavaScript and cookies enabled or
b) Mozilla FireFox 22.0 or newer version with JavaScript and cookies enabled,
c) Google Chrome version 30 or newer with JavaScript and cookies enabled,
d) Safari version 5 or newer with JavaScript and cookies enabled,
e) Opera version 20 or newer with JavaScript and cookies enabled,
f) screen resolution – at least 1200x800 pixels.
2.5. In accordance with applicable regulations, GoodyWoody reserves the right to limit the services provided by the online store to natural persons who are over 18 years of age. In such a case, potential customers will be informed about it.
2.6. The content presented on the website, i.e. descriptions, technical and operational parameters and information about products provided on the online store's website, constitute an offer within the meaning of Art. 66 of the Civil Code.
2.7. Customers can access these Regulations at any time by clicking on the link on the home page << www.goodywoody.com.pl >>, downloading and printing it.

Rules for using the online store

3.1. A User who wants to start using the Store and place orders for products must meet the requirements referred to in points 2 - 2.7.
3.2. Optionally, it is possible for the user to register an account. To register your account, the user must first complete and approve the registration form available on one of the online store pages.
3.3. To register an account or place an order without registration, the user must accept these Regulations and provide personal data marked as mandatory.
3.4. GoodyWoody may deprive the Buyer of the right to use the online store, as well as limit his/her access to some or all of its resources with immediate effect, in the event of a breach by the Buyer of these Regulations, i.e. when:
a) when registering in the Online Store, provided false, incorrect or outdated, misleading data or data violating the rights of third parties;
b) infringed the personal rights of third parties, i.e. other Customers, in the online store;
c) take other actions deemed by GoodyWoody to be inconsistent with applicable law or detrimental to the good name of GoodyWoody.
3.5. A person deprived of the right to use the online store cannot register further unless GoodyWoody consents.
3.6. In order to ensure the security of communication messages and data resulting from the services provided on its websites, GoodyWoody uses technical and organizational measures adequate to the security threats of the services provided, namely measures aimed at preventing unauthorized persons from obtaining and modifying personal data sent via the Internet.
3.7. The buyer will include, among others:
a) not to provide or disclose content prohibited by applicable law, e.g. content promoting violence or defamation or violating personal rights and other rights of third parties;
b) use the online store in a way that does not impede its functioning, i.e. by using specific software or devices;
c) not to take actions such as sending or posting unsolicited commercial information (spam) in the online store;
d) use the online store in a way that does not disturb other Customers and GoodyWoody;
e) use any content posted on the online store's website only for personal purposes;
f) use the online store in a manner consistent with the provisions in force in the Republic of Poland and with these Regulations.

Procedure for concluding a sales contract

4.1. To conclude a sales contract via the online store, go to www.goodywoody.com.pl, select the product(s) and take the next technical steps based on the displayed messages and information available on the following pages of the online store.
4.2. The customer selects the ordered products by adding them to the cart.
4.3. The summary of each placed Order must include the following information:
a) subject of the order;
b) unit and total price of the ordered products or services, including delivery costs;
c) selected method of payment;
d) selected method of delivery;

f) empty space for the Buyer's data.
4.4. In order to complete the order, the Buyer must accept the content of these Regulations, provide personal data marked as mandatory and press the "Order and pay" button.
4.5. By sending the Order and accepting its terms, the Customer expressed his will to conclude a sales contract with GoodyWoody under the terms of these Regulations.
4.6. When placing an Order and modifying the Goods in the basket and until the "Order and pay" button is pressed, the Buyer has the opportunity to modify the entered data. To do this, he must follow the messages displayed and information available on the website.
4.7. GoodyWoody is not responsible for the consequences of providing incorrect data by the Buyer when placing the Order.
4.8. The contract is considered concluded when the Buyer's Order is entered into the Online Store's IT system, provided that the Order complies with these Regulations and the payment process is successfully completed.
4.9. After concluding the contract, the Buyer receives an e-mail entitled Goody Woody: order confirmation, which contains all the essential elements of his Order.

The essential provisions of the Goods sales contract are recorded, secured, made available and confirmed to the Buyer by sending them to the e-mail address provided by the Buyer and by attaching a confirmation printout, Order specifications and a VAT Invoice to the shipment containing the Goods.
4/11. The sales contract is concluded in Polish and English (by Buyers placing Orders for the delivery of Goods outside the territory of the Republic of Poland) and is consistent with these Regulations.

Delivery

5.1. The goods are delivered to the address indicated by the Buyer when placing the Order.
5.2. The ordered Goods are delivered via Poczta Polska or a courier company.
5.3. Delivery costs within the Republic of Poland:
a) if you choose the Poczta Polska service, the costs will be estimated in accordance with the current postal price list, which can be found at http://cennik.poczta-polska.pl/
b) if UPS is chosen, the costs are XYZ;
In addition, delivery costs will be indicated at the time of placing the Order.
5.4. Delivery costs outside the Republic of Poland:
a) if you choose Poczta Polska services, costs are estimated according to the current postal price list available at http://cennik.poczta-polska.pl/
b) if UPS is chosen, the costs are XYZ;
In addition, delivery costs will be determined at the time of placing the Order.
5.5. Ordered products are shipped within three business days from the date of registering the Order in the GoodyWoody e-system. Delivery of ordered products in the Republic of Poland is carried out:
a) from 2 to 7 business days if you choose the Polish Post service;
b) from 2 to 4 business days if you choose UPS.
5.6. The delivery date outside the Republic of Poland will be estimated based on the information available on the website of Poczta Polska or UPS https://www.ups.com/.

Prices and payment methods

6.1. The prices of the Goods are given in Polish zlotys and include all necessary elements, including VAT (at a specific rate), customs duties and other elements.
6.2. The client can pay:
a) through PayPal;
b) by PayU;
c) credit/debit card.

d) Apple Pay

Withdrawal from the contract

7.1. If the Buyer is a Consumer within the meaning of the Civil Code, he may withdraw from the contract without giving a reason within 14 days.
7.2. The deadline for withdrawal from the contract expires after 14 days from the date of taking possession of the Goods by the Customer or a third party other than the carrier.
7.3. To exercise the right to withdraw from the contract, the Consumer should inform GoodyWoody of his decision to withdraw from the contract by an unambiguous statement in one of the following ways:
a) by traditional mail to the following address: "GoodyWoody Karolina Zielińska" ul. Jana Kazimierza no. 9, lok. 29, 01-248 Warsaw;
b) by e-mail to goodywoody@wp.pl.
The consumer may withdraw from the contract by sending GoodyWoody a declaration of withdrawal from the contract by completing the form constituting Annex 1 to the Regulations.
7.4. Immediately after receiving the declaration, GoodyWoody will send the Consumer confirmation of its receipt on a durable medium (electronically).
7.5. In order to meet the deadline for withdrawal from the contract, it is enough for the Consumer to send information to goodywoody@wp.pl regarding the exercise of his right to withdraw from the contract before the deadline referred to in point 7.2 of the Regulations.

Consequences of contract termination

8.1. In the event of effective withdrawal from the contract, GoodyWoody will refund to the Consumer all payments made to him, including the costs of delivering the goods (with the exception of additional costs resulting from the method of delivery chosen by the Consumer and other than the cheapest usual method of delivering the goods). delivery offered by GoodyWoody), immediately and in no case later than 14 days from the day on which GoodyWoody was informed about the decision to exercise the right to withdraw from this contract.
8.2. GoodyWoody will refund the amounts paid by the Consumer using the same payment methods used in the original transaction, unless the Consumer expressly agrees to a different solution; regardless of the case, the Consumer does not bear any costs in connection with this return.
8.3. GoodyWoody may withhold the refund of the amounts paid until we receive the goods or provide us with proof of sending them back, depending on which event occurs first.
8.4. The consumer should send or hand over the purchased Goods to the following address: "GoodyWoody Karolina Zielińska" ul. Jana Kazimierza no. 9, lok. 29, 01-248 Warszawa immediately, but no later than 14 days from the date on which he informed GoodyWoody about exercising the right to withdraw from this contract. The deadline is met if the Consumer returns the goods before the 14-day period expires.
8.5. The consumer is responsible not only for the reduction in the value of the goods resulting from using them in a way other than what was necessary to establish the nature, characteristics and functioning of the goods.

Guarantee and complaint

9.1. GoodyWoody provides defect-free products.
9.2. GoodyWoody assumes statutory liability for any defects in products ordered via the online store under the warranty for defects pursuant to Art. 556 and others of the Civil Code.
9.3. The Consumer has the right to submit complaints under the warranty for defects, while the Consumer or Buyer may submit complaints regarding the services provided by GoodyWoody electronically via the online store.
9.4. As a Seller, GoodyWoody is liable to the Consumer under the warranty for defects to the extent specified in the Civil Code. In the case of contracts concluded between GoodyWoody and a Buyer who is not a Consumer, liability under the warranty for defects in the sold goods is excluded.
9.5. Each complaint under the warranty for defects will be considered by GoodyWoody within a period no longer than 14 days from the date of its delivery to GoodyWoody. In the complaint, the Buyer should provide his name and surname, correspondence address and the type of violation. Complaints should be submitted electronically to the following address: goodywoody@wp.pl.
9.6. The Buyer has the right to submit a complaint, also regarding electronic services provided by GoodyWoody. The Buyer has the right to report to GoodyWoody any irregularities related to the conclusion of the sales contract, which he considers inconsistent with the quality of services disclosed before the conclusion of the given sales contract.
9.7. The Buyer has the right to submit a complaint about the Services provided by GoodyWoody within one (1) calendar month from the date on which the complained event took place. A complaint submitted after this deadline will not be considered, and GoodyWoody will immediately inform the Buyer. Complaints should be submitted to the e-mail address: goodywoody@wp.pl.
9.8. GoodyWoody will consider any complaint regarding services provided by GoodyWoody within no longer than 30 days from the date of its delivery. In the complaint, the Buyer should provide his name and surname, correspondence address, type and date of occurrence of irregularities in any service provided by the Seller.
9.9. At the same time, we would like to inform you that you can use out-of-court methods of dealing with complaints and pursuing claims in accordance with the Online Dispute Resolution procedure developed by the European Commission and available at https://webgate.ec. europa.eu/odr/main/?event=main.home.show.

Principles of responsibility

10.1. GoodyWoody is not responsible for any failure of its website due to force majeure events.
10.2. The Seller also reserves the right to suspend or discontinue the provision of Services in the event of maintenance work, inspections or expansion of the technical base, provided that the Consumer's rights are not violated.

Complaints regarding e-services

11.1. GoodyWoody takes steps to ensure the proper operation of the Store to the extent resulting from current technical knowledge and undertakes to remove any irregularities reported by Customers within a reasonable time.
11.2. The Customer is obliged to immediately notify GoodyWoody of any irregularities or failures of the Online Store website.
11.3. The Customer may report any irregularities in the operation of the Store in writing to the following address: "GoodyWoody Karolina Zielińska" ul. Jana Kazimierza no. 9, lok. 29, 01-248 Warszawa or by e-mail to goodywoody@wp.pl.
11.4. In the complaint, the Customer should provide his name and surname, correspondence address, type and date of irregularities in the operation of the Store.
11.5. GoodyWoody will consider each complaint within 14 days at the latest and if this is not possible, it will inform the Customer about the deadline for considering the complaint.

Final provisions

12.1. Any disputes arising between GoodyWoody and the Customer who is a consumer within the meaning of Art. 22[1] of the Civil Code will be resolved by competent courts in accordance with the applicable provisions of the Code of Civil Procedure.
12.2. Any disputes arising between GoodyWoody and a Customer who is not a consumer within the meaning of Art. 22[1] of the Civil Code shall be subject to the court having jurisdiction over the registered office of GoodyWoody.
12.3. In matters not regulated in these Regulations, the relevant provisions of the Civil Code, the Act on the provision of electronic services and other provisions of Polish law shall apply, and in the case of foreign consumers, also the legislation of the Consumer's country.
12.4. These Regulations enter into force on May 2, 2018.
